PATENTS
Averill & Green specializes in services including the drafting and prosecution of United States patent applications, including utility, design and provisional patent applications and patent infringement analysis. We also offer services that include coordinating the filing and prosecution of applications for foreign patents, foreign trademarks and PCT applications. If you have new ideas you want to protect, it is important that you understand the basic rules of patent law. Mistakes are often irreversible and we strongly recommend a consultation with a patent attorney as early as possible.
Patents provide a patent holder with the right to exclude others from making, importing, selling, or using the patented invention for the life the patent. A new and useful invention providing a functional benefit is protected by a Utility Patent. A new ornamental design is protected by a Design Patent. A Provisional Patent Application is a form of Utility Patent Application which provides a filing date for a Non-Provisional Patent Application filed within one year.
TRADEMARKS, SERVICE MARKS
Our firm also offers services related to prosecution and maintenance of Federal Trademarks and Service Marks. We also advise clients on the availability, registration, use, and enforcement of trademarks and service marks.
Trademarks are intended to inform consumers of the source of goods and services. Trademarks become very valuable as a business establishes a good reputation for quality and service and prevents against others using a similar mark which may create consumer confusion. A trademark protects words, phrases, symbols, or designs identifying the source of the goods or services of one party and distinguishing them from those of others. We advise clients of potential issues prior to using or filing a trademark or service mark and provide a search if requested. We strongly advise business owners to investigate the availability of a trademark or service mark before investing in advertising, packaging, brochures, etc.
